TERMS AND LIABILITY WAIVER

JM Halloween, Inc. dba Scarefest Scream Park reserves the right to refuse entry to any patron at any time, for any reason. Your ticket is a revocable license and admission can be refused or revoked at any time. By purchasing a ticket, accepting admission, and entering the premises, the holder—on behalf of themselves and their heirs—knowingly and voluntarily assumes full responsibility for all risks and dangers, both known and unknown, associated with Scarefest Scream Park. The holder agrees to forever waive, release, and covenant not to sue the operator(s), officers, directors, employees, volunteers, independent contractors, landlord, underwriters, agents, representatives, and affiliates from any and all claims, loss, liability, harm, injury, death, emotional distress, property damage, or any cost or expense whatsoever that may arise from ordinary negligence, directly or indirectly from attending this attraction or using any amenities at this location.

This is an indoor and outdoor, all-weather event held in the dark. You will experience audio and visual disturbances, extremely low visibility, low-clearance spaces, flashing/strobe lights, fog, special effects, loud noises, moving props, startle scares, sudden actions by actors, and damp or wet conditions. You will also encounter uneven walking surfaces in a physically demanding environment.

Holder warrants that they are in proper mental and physical health to participate. Do not enter if you are pregnant, prone to seizures, or have heart, back, respiratory, or other medical, physical, or mental conditions that could prohibit you from participating safely. Do not enter the attractions if you are intoxicated or under the influence of drugs or medication. Do not smoke, run, eat, or drink inside the attractions. Touching the actors, mechanisms, or props is strictly prohibited. Appropriate attire and closed toe shoes are required; masks and outside props are not permitted inside the park.  No video or flash photography is allowed inside the attractions. 

Holder grants Scarefest Scream Park the irrevocable, perpetual permission to use their photographic or video image captured on site in advertising, promotions, or other publications without compensation.

If any provision of this agreement is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. This agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles.
